DUI Attorney in San Bernardino California

Practice Areas - DUI

Paul Antill has an unmatched commitment to winning DUI cases. Our firm is dedicated to protecting clients’ rights. We strive to protect our clients’ drivers’ licenses from suspension and to reduce fines and jail time.

Penalties for drunk driving in California can be severe, even for a first offense. But a DUI or drunk driving arrest does not have to result in a conviction. That’s why it’s important to contact our firm immediately following an arrest and to make no statements to police. We work quickly aggressively to protect your rights and to begin preparing a strong defense.

California DUI and you

California’s Vehicle Code has two basic drunk driving laws:

  • 23152(a) It is a misdemeanor to drive under the influence of alcohol and/or drugs.
  • 23152(b) It is a misdemeanor to drive with .08% or more of alcohol in your blood.

You have legal rights when you are stopped for a DUI

Sometimes your legal rights are ignored by the police. While drunk driving laws have their place, many times an arrest may be unfair. You have a right to challenge your drunk driving arrest, unconstitutional road blocks, and other aspects surrounding your stop by the police. If you are stopped for DUI:

  • There must have been legally sufficient facts to constitute "probable cause" to stop, detain, and arrest you.
  • You should be advised that submission to field sobriety testing and portable field breath testing is not required by law.
  • You must be given a choice of breath or blood testing and if you refuse you must be advised of the legal consequences.
  • If you undergo a breath test at the police station, you must be given a chance to obtain a blood sample for later independent testing by your own attorney.
  • Things you can do if you are stopped for DUI
  • Unless you are under 21, decline to take any handheld breath test not required by law.
  • Agree to take a required "evidentiary" breath test if you are confident you are under .08%.
  • Politely decline to answer questions without an attorney.
  • Decline to take any field sobriety tests.

The best thing you can do is to hire a skilled DUI attorney to begin building your case and avoid harsh penalties. Note that in California, your DUI lawyer should call the DMV Driver Safety Office within 10 days and demand a hearing to contest your license suspension. Contact the Law Offices of Paul Antill, San Bernadino DUI lawyer if you are charged with DUI in California.
